How much does it cost to get a divorce? What are the filing fees?

Can I file a complaint without paying the court fees?
If you cannot afford to pay the court fees, you may not have to pay if you are receiving financial assistance under one or more of the programs listed in the Information Sheet on Waiver of Court Fees and Costs or your monthly income is less than the amounts shown therein or your income is not enough to pay for the common necessities of life for yourself and the people you support.

Do you require civil cover sheets on complaints?
Yes. Form #C-142. (Cal. Rules of Courts, rule 982.2, adopted 7/1/96.)

What is the filing fees for motions?
Refer to the Prior Fee Schedule. Current Fee Schedule.

When do I deposit jury fees?
Jury fees should be deposited with the Court 25 days before the trial.

Can you do a record search over the telephone?
No. You will either have to come down to the Clerk's Office and search the records or write us and request a search. Refer to Records . We charge $5.00 per year searched. You may also search for some Civil, Small Claims, and Probate cases on our on-line query page. On-line Civil Query.

Can I get a hearing date over the phone?
For Probate and Family Law matters, hearing dates are assigned when the papers are filed. At that time you may request certain hearing dates and if they are available we will oblige. For Discovery motions, please call the Clerk in Discovery for a hearing date. For matters heard in the Presiding Judge's Department 206Law and Motion Department 301 and 302, or Asbestos Department 220, you can pick your own date. Law and motion odd-numbered cases are to be set in Dept. 301; even-numbered cases are to be set in Dept. 302.

Is there a fee for an ex parte application?
Yes, the fee is $40.00. If it is a first paper for the party, appearance fee is also due. Check out the Fee Schedule.

When are ex parte hearings held in the departments for the Presiding Judge, Law & Motion, and Asbestos?
Ex parte hearings for Orders Shortening Time in the Presiding Judge Department 206, are held at 11:00 a.m., Tuesday through Friday.  Ex parte hearings in Law & Motion Department 301 are held at 11:00 a.m.  Ex parte hearings in Asbestos Department 220 are held at 11:00 a.m., Tuesday through Thursday.
